Dashcam’s Policy – English version

99 TECNOLOGIA LTDA. (“99”) states in this Dashcam’s Policy the rules of use of the device “Dashcam” by the Partner Driver, as well as how data and information, such as photos, videos and audio will be obtained, processed and stored for security purposes (“Dashcam’s Data”).

This Dashcam’s Policy is an integral part of 99’s Privacy Policy and subject to it. When using a Dashcam provided or certified by 99 or embarking on a trip monitored through it, the Partner Driver and/or Passenger agrees to the provisions set herein.

The Dashcam is an experimental initiative, still in testing phase, and the intention, together with other measures, is to improve the security conditions of the Application and/or of the 99’s Services. The Partner Driver and Passenger hereby declare that are aware of the experimental nature of the Dashcam and acknowledge that there is no expectation as to the level of quality or delivery of a specific service during the testing phase.

The Dashcam is a device voluntarily installed by the Partner Driver in his/her car, capable of performing audio monitoring, image and video recording while connected to the Application, regardless of whether there is an active ride or a Passenger on board.

The Partner Driver can activate or deactivate the Dashcam at his/her own discretion, subject to other provisions of this Dashcam’s Policy. If the Partner Driver no longer wants to use the Dashcam, he/she can disable and/or uninstall the Dashcam, provided that he/she also updates his/her registration information with 99 and informs that the Dashcam has been uninstalled.

If the Partner Driver chooses to use the Dashcam, it can be activated at any time while the Application is activated, either while available to receive rides or during a ride.

The Driver can only install the Dashcam in his own car and cannot install it in Rental Cars or third person vehicles.

99 recommends that the Partner Driver does not turn off the Dashcam in the course of a ride. If the Dashcam is turned off or has its operation compromised during the ride, 99 can interpret this as an emergency and it may also adopt measures that it deem appropriate, including the possibility of contacting the competent traffic and/or public safety authorities.

In combination with the Dashcam, the Partner Driver has also to display a legal notice provided by 99, inside and outside of the vehicle, to inform the Passenger that the environment is being monitored. 99 might provide the Partner Driver with additional instructions about the operation and functionalities of the Dashcam as necessary.

The Passenger will be informed about the existence of a Dashcam in the vehicle in the moment the ride is accepted by the Partner Driver. If the Passenger does not wish to travel in a vehicle monitored by the device, he/she may cancel the ride free of charge within the time period described in the application for cancelling rides.

All Data collected by Dashcam will be encrypted and sent directly to 99’s Safety Unit, without any local copy being stored.

The Dashcam’s Data will be used exclusively to monitor the ride for the purpose of improving safety and are subject to the protections and guarantees of 99’s Privacy Policy. The Dashcam’s Data will not be used for purposes not informed in this Dashcam’s Policy. The Dashcan’s Data will not be made available to Partner Drivers and Passengers, except in strict compliance with legal obligations, subject to procedures determined by 99, and  in accordance with the law.

The Dashcam’s Data will not be shared with third parties, except in the cases described below

i) For agencies, offices and other entities of the public authorities, as well as to individuals or private legal entities, in fulfillment of a legal obligation or judicial order; and

ii) to the police authorities or to the representative of the Public Prosecution’s Office, regardless of the existence of a specific legal obligation or judicial order, when, exceptionally, there is a reasonable suspicion of the occurrence of a violent crime or serious threat under emergency circumstances, involving users of the Application, or if it is necessary to protect rights, properties or the safety of 99, its users or third parties.

The Dashcam is protected by intellectual property law. Therefore, if the Partner Driver and/or Passenger make any changes thereto, whether on the device itself or in its software, he/she is committing serious misconduct and may have its account suspended or canceled, without prejudice to other civil and criminal penalties provided for by law.

THE PARTNER DRIVER AND/OR PASSENGER, IN THE TERMS OF THIS DASHCAM’S POLICY, HEREBY CONSENT TO THE TREATMENT OF THEIR DATA, OBTAINED THROUGH THE DASHCAM. THE PARTNER DRIVER AND/OR PASSENGER, FURTHER PROVIDE THE LICENSES AND AUTHORIZATIONS NECESSARY TO THE USE OF THEIR IMAGE AND VOICE UNDER THE TERMS OF THIS DASHCAM’S POLICY. THE DATA TREATMENT REFERRED TO IN THIS DASCHAM’S POLICY IS AUTHORIZED FOR THE PURPOSE OF IDENTIFYING AND PROTECTING THE PARTNER DRIVER AND THE PASSENGER, AND FOR THE PREVENTION AND FIGHT AGAINST FRAUD AND SAFETY INCIDENTS WHILE USING THE APPLICATION AND SERVICES OF 99.

The Dashcam Data is stored by 99 on secure servers, in accordance with the Privacy Policy. The Dashcam Data that can be used to identify Partner Drivers and/or Passengers will be completely excluded within 6 (six) months after its collection.
