99 may collect your information, including data that can identify you, under certain circumstances, including:
- When creating your account at 99; and
- When you access our site or use 99’sApp and Services.
- When using the Application, while it remains active in the foreground and background (when the application is open but not displayed on the device screen), including during your trips.
Upon registering with 99, you provide certain informations, such as your name, photo, address, telephone number, email, CPF (Individual Taxpayer’s Register Number), CNH (Driving License), RENAVAM (National Registry of Motor Vehicles), sex, date of birth, RG (Identity Card), proof of residence, among others. Other information may be collected and processed by 99 due to the applicable legislation.
99 also requires that, for you to use the Emergency Contact feature, you allow it to access your address book. If you do not grant such access, you shall not use the Emergency Contact feature.
As you use 99’s App and Services, including during your rides, additional information may be obtained by 99, such as your geographical location, route, length of trip, IP address, browser used, cookie information, type and brand of mobile device, mobile device identifiers, operating system version, installed software, network information, internet connection provider, configuration of devices, software data, usual pick up and drop off locations, routes, evaluations of 99’s Service, financial data, payments used and their amounts, communication made through the 99’s App and communication made between you and 99 using our service channels.
If you do not provide any of the requested information, 99 cannot guarantee the quality or accuracy of 99’s App and Services. In this case, 99 has the right to remove you from 99’s platform immediately, inclusive to assure the safety and regular working of 99’s App and Services to other users.
99 may also obtain information about you from public and private databases, business partners and/or other service providers when you link your Account to these providers (“Third Parties”), provided that such Third Parties obtained this information according to the applicable legislation. This information may be associated with other informations that 99 collects about you and be used in the scenarios and purposes described in Section 3. The information provided by Third Parties to 99 follow the proper discipline established by such Third Parties and may be subject to their respective privacy policies.
- Protection and Storage
99 collects personal information from you and, for that reason, the security of your data is a priority.
99 uses adequate information security practices in all its systems and infrastructure, including physical and digital security measures to ensure the protection of your personal data. This measures include access control, strong encryption, SSL implementation, firewalls, change logging and double authentication factor, among other mechanisms and protocols. Regarding the financial data, additional security measures will be applied according to the applicable regulations.
The information obtained by 99 might be stored on servers in Brazil or abroad at the sole discretion of 99. You understand and agree that other countries may have different levels of data protection than Brazil. Without prejudice, information stored in another countries shall be protect with security measures at least equivalent to those described in the previous paragraph.
The security measures described above apply to your information only after 99 receives them and maintain under its guard. The working and security of the device that you use to access 99’s App and Services, as well as the network through which the data travels, are your responsibility. To ensure a more secure environment, 99 suggests (without a guarantee against incidents) that you follow these basic safety precautions:
- Distrust emails from unknown sender;
- Do not access suspicious sites;
- Maintain active and up-to-date protection mechanisms, such as anti-virus and anti-malware;
- Do not install applications or programs from unknown or illegal sources; and
- Do not access “promotional content” from unknown sources.
- Use and Sharing
Your information, including your personal data, will be used to provide and aesthetically/functionally enhance 99’s App and Services, as well as other purposes described in this section. Except as provided below, your information will not be shared with third parties by 99.
Specifically, 99 will use the collected information for the following purposes:
(i) to provide, supply, maintain, develop, enhance, disseminate and extend use of the 99’s App and Services;
(ii) to identify you and customize your experience and use of 99’s App and Services, including promotions and financial incentives;
(iii) to generate analysis and statistical reports about the functioning and operation of 99’s App and Services for the benefit of 99 and/or its partners;
(iv) to enable 99 to contact you about 99’s App and Services, as well as to provide user support;
(v) to provide and improve security and monitoring mechanisms for 99’s App and Services, including security monitoring during a trip;
(vi) to detect and protect 99 and users against fraud, abuse or illegal acts;
(vii) to detect and avoid the use of softwares that allows frauds or changes the behavior and functionalities of 99’s App and Services;
to develop new products, services and functions;
(viii) to conduct research and scientific analysis;
(ix) to conduct risk control and criminal background checks; and
(x) to comply with legal obligations to collect and share data with the government, according to applicable law and regulations.
Your contact information will be used by 99 to communicate directly with you and to send relevant information, including transaction information, service notices, special service offers, event announcements, relevant news, best practices, among others.
Your financial data will be used to pay for the rides and to transfer the value thereof to the Drivers, except in the transfer scenarios set forth below.
99 will not share or give to third parties your information, including your personal data, as listed in Section 1, except:
(i) when you request or authorize 99 to share;
(iii) to allow and provide 99’s App and Services in an appropriate manner and in the manner you have contracted.
(iv) with commercial partners providing services or working on behalf of 99, according to the specifications and guidelines determined by 99, including non-disclosure and confidentiality of data clauses;
(v) to Public Authorities, Police and other Public Agencies to comply with the law and regulation applicable to 99’ App and Services;
(vi) to Public Authorities, Police and other Public Agencies, as well as persons and companies, by virtue of a law or court order;
(vii) For the Police or Public Prosecutor’s Office authority, independently of the existence of law or judicial order, when, at 99’s discretion, there is suspicion, flagrant or investigation of crime using violence or serious threat or is needed to protect the rights, property or safety of 99, its users or the public;
(viii) in the exercise and defense of 99’s rights, at its own discretion, including in legal or administrative proceedings; and
(ix) if the ownership or control of 99 or its controlling entity is changed by reason of consolidation, acquisition or sale of assets.
- Exclusion of personal data
If you wish to exclude the personal data held by 99, you need to request the exclusion directly to the company.
To proceed with the deletion, you must delete 99’s App and contact 99 to request the definitive deletion. So, simply uninstalling the 99’s App does not exclude your personal data.
In accordance with the applicable legislation, 99 may keep certain personal information stored for a period of not less than six (6) months after your exclusion request. Your information will not be made anonymous or destroyed before the end of this term.
99 will store your request for exclusion and, once the legal deadline has expired, will provide for the destruction or anonymization, at the company’s sole discretion, of the information capable of identifying you.
However, if you request the exclusion of your information, but you have outstanding obligations to 99, including unpaid fees, and negative balance, your data will not be deleted and shall be stored to allow the resolution or execution of the debt.
